¶1Heard Sri Prashant Kumar Singh, learned counsel for applicants, learned counsel for opposite party no. 2 and Sri Rajeev Kumar Singh, learned A.G.A. for the State.

¶2The present application has been filed for quashing of the entire proceeding of Special Session Trial No. 82 of 2013, Awadhesh Kumar Vs. Laxmi Narayan and others, under Section 392 IPC, Police Station-Kakavan, District - Kanpur Dehat pending in the court of Special Judge, D.A.A./Additional Sessions Judge, Court No. 4, Kanpur Dehat.

¶3Learned counsel for the applicants, after some argument, submits that he does not want to press the prayer to quash the impugned proceedings and further submits that the petitioners want to surrender before the Court below and apply for bail, therefore, necessary directions may be issued for expeditious disposal of their bail application.

¶4Considering the aforesaid submission, the present application is disposed of with a direction that if the applicants surrender and move an application for bail before the court below within a period of three weeks from today, then their application shall be considered in view of the law laid down in Satendra Kumar Antil vs. Central Bureau of Investigation and Another, (2021) 10 SCC 773.

¶5For a period of four weeks or till disposal of the bail application, whichever is earlier, no coercive action shall be taken against the applicants. Order Date :- 30.10.2023 S.K.S. High Court of Judicature at Allahabad
