1.Heard learned counsel for the petitioners and Mr. Abhishek Shukla, learned Additional Chief Standing Counsel for State-respondents.

2.The instant writ petition has been filed for the following relief: "(i) issue a writ, order or direction in the nature of mandamus directing the respondent Nos.5 and 7 not to enter or construction on the disputed land in question.

(ii) issue a writ, order or direction in the nature of certification quashing the order dated 11.09.2017 passed by respondent No.4 and order dated

29.08.2019 passed by respondent Nos.3 and order dated 30.01.2020 passed by respondent No.2."

¶3Brief facts of the case are that respondent Nos.6 and 7 filed an application under Section 34 of U.P. Revenue Code, 2006 before respondent No.4/Tehsildar for recording of their names on the basis of sale deed dated

26.09.2016. Petitioners claimed the right on the basis of succession in respect to the holdings of original tenure holders Jageshwar Shukla son of Sri Gayacharan. Sri Jageshwar Shukla, alleged to have executed a sale deed on 03.06.1987 in favour of respondent no.5 Krishna Kumar Mishra. Respondent No.5 Krishna Kumar Mishra alleged to have executed a sale deed on 26.09.2016 in favour of respondent No.6 and 7 (Dheeraj Bajpai and Sailesh Bajpai) Tehsildar vide order dated 11.09.2017 ordered to expunge the name of Jageshware Shukla and Bhuvneshwar Prasad, Kamlesh Kumar, Akhilesh Kumar and Smt. Girija Devi and ordered to record the name of respondent Nos.6 and 7 Dheeraj Bajpai and Sailesh Bajpai on the basis of sale deed dated

04.06.1987/26.09.2016. Against the order dated

11.09.2017, petitioners filed an appeal under Section 35

(2) of U.P. Revenue code, 2006 which was registered as Case No. 3561 of 2017 computerized case No.2017071142013561. Sub Divisional Officer vide order dated 29.08.2019 dismissed the appeal filed by petitioners. Petitioners challenged the appellate order dated 29.08.2019 through revision under Section 210 of the U.P. Revenue code, 2006, which was registered as case No. 1036 of 2019 computerized case No. C20190700000501036 Divisional Commissioner Ist Chitrakoot Division Banda vide order dated 30.01.2020 dismissed the revision filed by the petitioners, hence this writ petition challenging the order dated 11.01.2017,

29.08.2019 and 30.01.2020 passed by respondent Nos.4, 3 and 2 respectively. The writ petition has been filed with the laches of 1239 days as reported by Stamp reporting Section of this Court.

¶4Learned counsel for the petitioners submitted that name of the contesting respondents has been illegally recorded in the proceeding under Section 34 of U.P. Revenue Code, 2006 on the basis of the sale deed. He further submitted that appeal and revision filed by the petitioners has also been dismissed in arbitrary manner. He next submitted that civil suit filed by the petitioners for declaring the sale deed null and void as well as for injunction is pending before the civil court being civil suit No.204 of 2018. He further submitted that suit is pending in the civil court, as such Tehsildar should not record the name of the vendees on the basis of the alleged sale deed. He further submitted that impugned order be set aside and matter be examined afresh by Tehsildar. He further submitted that petitioners are claiming on the basis of succession but the petitioners' case has not been considered at all in proper manner and mutation application filed by the contesting respondents has been allowed.

¶5On the other hand, Mr. Abhishek Shukla, learned Additional Chief Standing Counsel for the State-respondent submitted that all three courts in the mutation proceeding have concurrently decided against the petitioners recording finding of fact that vendees are entitled to be recorded on the basis of registered sale deed. He further submitted that registered sale deed has not been cancelled at all by any court of law as such there is no illegality in the order passed in the mutation proceedings which are summary in nature and writ petition filed by petitioners should be dismissed. He further submitted that Civil Suit No.204 of 2018 filed by petitioners has been dismissed on 13.03.2023 and restoration/ recall application has been filed on behalf of petitioners for recalling the order dated 13.03.2023 which is pending before the civil court.

¶6I have considered the argument advanced by learned counsel for the parties and perused the record.

¶7There is no dispute about the fact that mutation application filed by the contesting respondents on the basis of sale deed has been allowed by the Tehsildar and order has maintained in appeal and revision.

¶8The perusal of the finding of fact recorded by Tehsildar vide order dated 11.09.2017 will be relevant for perusal which is as under: "

¶9The finding of fact recorded by the Tehsildar fully demonstrate that registered sale deed has been executed in favour of the contesting respondents which has not been cancelled till date as such contesting respondents are entitled to be recorded on the basis of sale deed.

¶10It is also material that Civil Suit for declaration of sale deed dated 03.06.1987 and 26.11.2016 as null and void as well as for decree of permanent injunction has been dismissed and petitioners' restoration application dated

04.07.2023 is pending before the Civil Judge Junior Division, as such petitioners should avail proper remedy in the pending proceeding before Civil Court rather before mutation Court.

¶11In view of the finding of fact recorded by Tehsildar/ Sub Divisional officer, Banda no interference is required in the matter and writ petition is dismissed.

¶12Needless to say that order passed in the mutation proceeding shall not come in the way of the petitioners to establish their claim before the civil court in the pending civil suit . Order Date :- 30.10.2023/PS* High Court of Judicature at Allahabad
