¶1Heard learned counsel for applicants and the learned A.G.A. for the State.

¶2Perused the record.

¶3This application under Section 482 Cr.P.C. has been filed by the applicant with a prayer to quash the complaint dated 17.05.2018, order dated

13.11.2018 passed by learned Chief Judicial Magistrate, Auraiya and proceedings of Case No.1652 of 2018 (240 of 2018) (Ram Lakhan vs. Anand Kumar and Others) under section-395 I.P.C., Police Station-Dibiyapur, District-Auraiya, pending before the court of learned Chief Judicial Magistrate, Auraiya.

¶4After some arguments, learned counsel for the applicants wants to withdraw the application with liberty to applicants to file their bail applications before the court of competent jurisdiction.

¶5In view of the above, the application is disposed of as withdrawn with liberty to the applicants to appear before court below and file their appropriate applications for bail before the court below, which shall be decided by court below in the light of decision rendered in Satender Kumar Antil Vs. Central Bureau of Investigation and another, Special Leave to Appeal (Crl.) No (s) 5191 of 2021 decided on 07.10.2021. Order Date :- 30.10.2023/Saif High Court of Judicature at Allahabad
