¶1Heard learned counsel for the applicant and learned A.G.A for the State as also perused the record.

¶2This application under Section 482 Cr.P.C. has been filed seeking direction to the court below to decide the Case (Final Report ) No.3058 of 2022 (Old No. 1617 of 2021) (Naseem Vs. Nadeem) under Sections 376, 328, 506 I.P.C., P.S. Daurala, District Meerut.

¶3Counsel for the applicant submits that applicant is informant and lodged F.I.R. against the opposite party no. 2 under Sections 376, 328, 506 I.P.C. as Case Crime No. 435 of 2019. The Investigating Officer submitted final report on 31.10.2020. The trial court issued notice to informant on final report and applicant appeared in the proceedings and moved application on 05.08.2022. On 18.10.2022 the learned Magistrate has taken statement of the applicant, thereafter no order has been passed and the proceedings is pending before the court below.

¶4Considering the aforesaid facts, without expressing any opinion on the merits of the case, this application is finally disposed of with a direction to the court below to decide the aforesaid case in accordance with law, as expeditiously as possible, without granting any unnecessary or long adjournments to either of the parties, preferably within a period of one month from the date of production of a certified copy of this order, if there is no other legal impediment.
