¶1Heard Sri Mohammad Danish, learned counsel for the petitioner and Sri Virendra Kumar Pal, learned A.G.A. for the State.

¶2The present writ petition has been preferred with the prayer to quash the impugned First Information Report dated 13.05.2023 registered as Case Crime No. 135 of 2023, under sections 420, 467, 468, 471, 506 IPC, P.S. Mainather, District Moradabad, and for a direction to the respondents not to arrest the petitioner in pursuance of impugned First Information Report.

¶3At the very outset, learned A.G.A. pointed out that except the petitioner, charge-sheet has been submitted against all other five co-accused persons.

¶4At this stage, learned counsel for the petitioner submits that he may be permitted to withdraw the present writ petition with liberty to avail the remedy as may be available to petitioner in accordance with law.
