¶1Heard learned counsel for the applicant and learned A.G.A for the State as also perused the record.

¶2This application under Section 482 Cr.P.C. has been filed seeking direction to the court below to decide the Sessions Trial No.106 of 2007 (State Vs. Vivek Singh and others) Case Crime No.40 of 2007, under Sections 302, 307, 504 I.P.C., and 7 Criminal Law Amendment Act, 3/25 Arms Act and 3(1) U.P. Gangsters Act, P.S. Bansgaon, District Gorakhpur.

¶3Counsel for the applicant submits that applicant is wife of informant and informant is no more which is stated in Para-11 of the affidavit. He next submits that F.I.R. was lodged in the year 2007, thereafter, Investigating Officer submitted charge sheet and court has taken cognizance on 05.09.2007 but since 2007, no charge has been framed against the opposite party nos 2 to 5.

¶4Considering the aforesaid facts, without expressing any opinion on the merits of the case, this application is finally disposed of with a direction to the court below to decide the aforesaid case in accordance with law, as expeditiously as possible, without granting any unnecessary or long adjournments to either of the parties, preferably within a period of four months from the date of production of a certified copy of this order, if there is no other legal impediment.
