Judgment

Court No. - 43 Case :- CRIMINAL MISC. WRIT PETITION No. - 16963 of 2023 Petitioner :- Asad Alam Khan Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Mohd Imran Khan Counsel for Respondent :- G.A. Hon'ble Anjani Kumar Mishra,J. Hon'ble Vivek Kumar Singh,J. Heard learned counsel for the petitioner and learned A.G.A. for the State. The instant writ petition seeks quashing of the FIR dated 9.10.2023 giving rise to Case Crime No.13 of 2023, under Sections 419, 420, 467, 468, 471 I.P.C., Police Station-Paryatan, District-Agra (Commissionerate). The contention of the learned counsel for the petitioner is that the only allegation in the first information report is that the petitioner is working as Guide without valid license or with forged license. It is also contended that infact first information report is malicious and the petitioner is working under the orders of High Court and that the process of grant of valid license is undertaken and is pending for a while. Since counsel for the petitioner is not able to provide any valid license as it has been submitted before the Court that the grant of license is still in process, the allegation in the first information report is borne out under such circumstances. The allegations made in the First Information Report clearly disclose commission of cognizable offences and the allegations are serious in nature. Therefore, prayer of the petitioner to quash the First Information Report is completely misconceived and is rejected. The writ petition is therefore dismissed, without prejudice to the right of the petitioners to apply for bail/anticipatory bail. Order Date :- 30.10.2023 Dev/- High Court of Judicature at Allahabad
