19.12.2022 in O.A. No. 3680 of 2022. A preliminary objection has been raised by learned counsel for the respondent Railways that the petitioner has still an alternative efficacious remedy before the Tribunal in the first instance against the order passed by the authority concerned. To the above legal position, learned counsel for the petitioner does not dispute. Accordingly, I decline to entertain this petition at this stage and liberty rests with the petitioner to apply before the Tribunal, if so advised. Accordingly, this petition is consigned to records.
