¶1From the record it appears that the petitioner was the guarantor for the loan which one Rajendrawati had taken. When the borrower became a defaulter, proceedings under the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (herein after referred to as the "SARFAESI Act") were undertaken and consequently a notice was issued on 10.08.2023 to the petitioner. It is also evident from the record that the possession of the mortgaged property was taken over on 19.12.2022 under Section 14 of the SARFAESI Act.

¶2If the petitioner is aggrieved by the action taken under the SARFAESI Act, it is always open to the petitioner to take recourse to such action as might be available to her under the SARFAESI Act.
