Court No. - 32 Case :- WRIT - C No. - 36491 of 2023 Petitioner :- Chandrapal Singh And 2 Others Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Meraj Ahmad Khan Counsel for Respondent :- C.S.C Hon'ble Salil Kumar Rai,J. Hon'ble Surendra Singh-I,J. The grievance of the petitioners in the present petition is that the respondents-state authorities have encroached upon the land of the petitioners for constructions of an irrigation canal under the Madhya Ganga Nahar Nirman Division, Chandausi District Shambhal and are not paying compensation to the petitioners for the same even though the other co-owners have already been given compensation. In this context, the petitioners have made several representations but it has been stated in the writ petition that no decision is being taken by the Executive Engineer, Madhya Ganga Nahar Nirman Division, Chandausi District Shambhal, i.e., respondent no.2 on the aforesaid representation of the petitioners. The petition is disposed of with a direction that in case the petitioners file a fresh representation before the Executive Engineer, Madhya Ganga Nahar Nirman Division, Chandausi District Shambhal, i.e., respondent no.2 bringing all the necessary facts to his notice, the Executive Engineer, Madhya Ganga Nahar Nirman Division, Chandausi District Shambhal shall pass appropriate orders on the representation of the petitioners in accordance with law within a period of three months from the date a copy of this order is produced before him. It is clarified that this Court has not expressed any opinion on the merits of the claim made by the petitioners. With the aforesaid direction, the petition is disposed of.
