Cooperative Federation Limited, Chandauli, i.e., the respondent No. 3 that dispute between petitioner and the contesting respondent No. 3 regarding the liability of respondent No. 3 to pay commission for the wheat purchased by the petitioner has been referred to the Arbitrator under Sections 70/71 of the Uttar Pradesh Co-operative Societies Act, 1965 (hereinafter referred to as, 'Act, 1965'). The arbitration case has been registered as 2 of 2023 and is pending before the Arbitrator/Joint Commissioner and Joint Registrar Cooperative Societies, Varanasi Division, Varanasi. It has been further stated that the petitioner has also appeared in the aforesaid arbitration case. In view of the aforesaid, it is not a fit case for interference by this Court under Article 226 of the Constitution of India at this stage. The petition is dismissed.
