Judgment

Chief Justice's Court Case :- WRIT TAX No. - 1247 of 2023 Petitioner :- M/S Lg Electronic India Private Limited Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Atul Gupta,Prakhar Shukla Counsel for Respondent :- C.S.C. Hon'ble Pritinker Diwaker,Chief Justice Hon'ble Ashutosh Srivastava,J. The limited grievance, which has been putforth by the petitioner in this petition, is that show cause notice dated 27.9.2023 is bad in the eyes of law as the officer, who had issued the same, has already prejudged the issue. Learned counsel for the petitioner submits that purpose of filing the present writ petition would be served if a direction is issued to respondent No.2 for assigning the case of the petitioner to some other officer of similar rank and the petitioner may be permitted to file his reply before the said officer, who would be deciding the same in accordance with law. Learned Standing Counsel for the State submits that let petitioner file a reply to the show cause notice within three weeks, which may be considered by the officer other than the present one. He further submits apart from this direction, no other relief can be granted to the petitioner. Without expressing any opinion on the merits of case, the petition is disposed of directing the petitioner to file reply to the impugned show cause notice within three weeks from today and in turn respondent No.2 shall look into the matter and assign the same to some other officer. Any finding recorded herein above is only for the present case. Order Date :- 31.10.2023 Kuldeep (Ashutosh Srivastava,J.) (Pritinker Diwaker,C.J.) High Court of Judicature at Allahabad
