Judgment
Court No. - 5 Case :- WRIT - C No. - 35899 of 2023 Petitioner :- M/S U.P. Electronics Corporation Ltd. Respondent :- Dileep Kumar And Another Counsel for Petitioner :- Ashok Trivedi Counsel for Respondent :- CSC,Anil Kumar Srivastava,Gaurav Srivastava Hon'ble Piyush Agrawal,J. Heard learned counsel for the petitioner and Shri S.D. Kautilya, learned counsel for the respondent no. 1. At the very outset, Shri Kautilya raises a preliminary objection with regard to the maintainability of the writ petition by submitting that no claim has been made by the respondent no. 1 against the petitioner as there is no employee-employer relationship with the petitioner. He further submits that the respondent no. 1 was the employee of one U.P. Apron India Limited, which is in liquidation and therefore, the present writ petition is not maintainable. On the said submission, learned counsel for the petitioner submits that if this fact is admitted by the respondent no. 1 and in case the respondent no. 1 does not make any claim in future against the petitioner, he has no grievance. In view of the above, the writ petition is disposed of. Order Date :- 31.10.2023 Amit Mishra High Court of Judicature at Allahabad
