Judgment

Court No. - 10 Case :- WRIT - C No. - 32992 of 2023 Petitioner :- Ravindra Nath Tiwari Respondent :- State Of U.P. And 5 Others Counsel for Petitioner :- Manish Nath Tripathi Counsel for Respondent :- CSC Hon'ble Kshitij Shailendra,J.

¶1Heard Sri Manish Nath Tripathi, learned counsel for the petitioner and Sri I.P. Srivastava, learned Additional Chief Standing Counsel, for the respondents no.1 to 3.

¶2This writ petition has been filed claiming following relief:- "(i) Issue a writ, order or direction in the nature of mandamus, commanding the Respondent no. 3 Assistant Registrar, Firm, Society and Chits, Gorakhpur Region, Gorakhpur to forthwith decide pending adjudication of membership dispute after putting all stake holders to notice and opportunity, by way of reasoned speaking order, to be passed within stipulated period of time as may be specified by the Hon'ble Court."

¶3It appears that the petitioner wants some action against the elected Committee of Management and proceeded to move complaints.

¶4At one stage complaint was entertained by the Registrar sitting at Lucknow who directed the Assistant Registrar, Firms, Societies and Chits, Gorakhpur to send a report. The Assistant Registrar has already called upon the respondent no.6 by notice dated

08.06.2023 to produce the evidence of his membership.

¶5Learned counsel for the petitioner submits that the said proceedings be directed to be decided expeditiously.

¶6I am not satisfied with the locus of the petitioner who appears to be merely a complainant in the matter and his application moved to the Registrar, Lucknow contains reference of various other proceedings which have come before this Court on earlier occasions.

¶7There may be some factual aspects and proceedings in relation to the office bearership of the Committee and the Court does not find any good ground to issue a writ of mandamus on the writ petition filed by the person whose locus is not clear in the case nor otherwise, as the authority is already proceeding in the matter.

¶8The writ petition is dismissed. Order Date :- 31.10.2023 AKShukla/- High Court of Judicature at Allahabad
