¶1Heard learned counsel for the petitioner, Mr. Pankaj Kumar Gupta, learned learned counsel for the respondent No.5-Village Panchayat and learned Standing Counsel for State-respondent.

¶2The instant public interest litigation has been filed for mandamus directing the respondent nos.3 and 4 to remove the illegal encroachment made by the respondent No.6 over plot No.206 area 0.0880 hectare which is recorded as Banjar land in the revenue records.

¶3Mr. Pankaj Kumar Gupta, learned learned counsel for the respondent No.5-Village Panchayat placed instruction dated

21.10.2023 in which it is mentioned that proceedings under Section 67 of U.P. Revenue Code, 2006 have been initiated and five cases have been registered against the persons who are in possession over the same. The particulars of the case are as follows :- i. T202317650103866, ii. T202317650103867, iii. T202317650103868, iv. T202317650103869 and v. T202317650103870.

¶4In view of the facts mentioned in the instructions dated

21.10.2023 the instant PIL is finally disposed of directing he respondent No.4 i.e. Assistant Collector/Tehsildar, Tehsil Dhanghata, District Sant Kabir Nagar to decide the aforementioned five cases after giving an opportunity of hearing to the parties in accordance with law expeditiously preferably within a period of four months from the date of production of certified copy of this order before him, the particular of five cases are as follows :-
