¶1Heard learned counsel for the petitioner and Mr. Sanjay Kumar Srivastava, learned State Law Officer for State-respondent.

¶2The instant petition has been filed for mandamus directing the respondent nos.3 and 4 to i.e. District Magistrate, District Farrukhabad and Sub Divisional Magistrate, Tehsil Kayamganj, District Farrukhabad to enquire the matter on spot and demarcate the land in question under the provisions of U.P. Revenue Code, 2006 and thereafter take appropriate action against the respondent No.5.

¶3Learned counsel for the petitioner submitted that in respect of application filed before the authority concerned, the demarcation has not been made. He further placed the application filed before the authority which has been perused by me.

¶4The application filed by the petitioner is not proper application for demarcation as provided under Section 24 of U.P. Revenue Code, 2006 read with Rule 22 of U.P. Revenue Code Rules 2016, as such prayer made in the writ petition cannot be entertained.

¶5Considering the facts and circumstances of the case, the writ petition is finally disposed of directing the petitioner to file proper application for demarcation before respondent No.3 Sub Divisional Magistrate as provided under Section 24 of U.P. Revenue Code, 2006 complying the provision of Rule 22 of U.P. Revenue Code Rules 2016 within a period of two weeks from today which shall be decided by respondent No.3 in accordance with the provision contained under Section 24 of U.P. Revenue Code, 2006.
