Heard learned counsel for the petitioner, learned Standing Counsel and Ms. Monika Garg holding brief of Sri Ashish Agrawal learned counsel for the Bank. From the record, we find that as of today, the petitioner has to pay Rs. 3,37,790.86/- plus whatever interest which might have accrued till today. Learned counsel for the petitioner has stated that the action has been taken under the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002, and date for auction was fixed for 13.10.2023 but the auction was not successful on that date. Learned counsel for the petitioner has stated that no further date has been fixed for auction. Learned counsel for the Bank does not dispute the fact that no further date for auction has been fixed. He, however, submits that if the petitioner approaches the Bank it would consider the settling of the account. Under such circumstances, no interference is warranted. However, if the petitioner approaches the Bank with a proposal to pay off the amount due, then the Bank would consider the proposal of the petitioner sympathetically.
