¶1Heard Sri Krishna Kumar Patel, learned counsel for petitioner and learned Standing counsel for State respondents.

¶2Present petition has been filed seeking direction in the nature of mandamus commanding the respondent no. 2 to decide the suit no. T202302030402920 (Ram Sumer Vs. Kevali Devi and others) under Section 116 of U.P. Revenue Code, 2006 pending in the court of Sub Divisional Magistrate, Handia, Prayagraj within stipulated period of time as fixed by this Hon'ble Court and further restrain the respondent nos. 3 to 6 from the illegal construction or otherwise interference over gata no. 488 area 0.0820 hectare situated at village Dayalapur, Pargana Mah, Tehsil Handia, District Prayagraj.

¶3At the very outset, learned Standing counsel for State respondents came up with specific instructions which is taken on record through which it transpired that whatever illegal construction was being made by respondents has been stopped by the revenue authorities and proceedings of case no. T202302030402920 are already underway and next date fixed for hearing in it is 22.11.2023 and as such no cause of action further survives for petitioner to pursue the instant petition.
