Judgment

Court No. - 44 Case :- CRIMINAL MISC. BAIL APPLICATION No. - 46031 of 2023 Applicant :- Satyam Singh @ Bauna Opposite Party :- State of U.P. Counsel for Applicant :- Sudarshan Singh Counsel for Opposite Party :- G.A. Hon'ble Pankaj Bhatia,J.

¶1Heard learned counsel for the applicant, learned AGA and perused the record.

¶2The accused-applicant seeks bail in Case Crime No.278 of 2023 under sections 323, 504, 506, 34, 307 IPC, P.S. Mughalsarai, District Chandauli.

¶3The FIR in question was lodged initially under section 323, 504, 506 IPC alleging that on account of sound created by a DJ, the dispute occurred in between the parties which resulted in infliction of injuries on the son of the informant.

¶4The counsel for the applicant draws my attention to the medical report which is on record to argue that no case can be said to be made under section 307 IPC in view of the injuries. The applicant has no criminal history.

¶5Considering the fact that the dispute arose on account of trivial issue of sound created by the DJ and the medical report prima-facie does not indicate the offence under section 307 IPC, the applicant who is in custody since 23.08.2023 and has no criminal history is entitled to be enlarged on bail. Thus the bail application is allowed.

¶6Let the applicant Satyam Singh @ Bauna be released on bail in aforesaid first information report number subject to his furnishing a personal bond and two reliable sureties each of the like amount to the satisfaction of the court concerned with the following conditions:

(a) The applicant shall execute a bond to undertake to attend the hearings;
