Judgment
Court No. - 40 Case :- WRIT - C No. - 27805 of 2023 Petitioner :- Mohd Qasim Shahi Alias Mohd Qasim Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Umair Mahmood Counsel for Respondent :- C.S.C.,Kunal Ravi Singh Hon'ble Mahesh Chandra Tripathi,J. Hon'ble Prashant Kumar,J.
¶1Heard learned counsel for the petitioner and learned counsel for the contesting-respondent no. 2.
¶2The petitioner who is claiming to be a RTI activist, is aggrieved by the order impugned dated 26.7.2022 passed by the second respondent, whereby, first appellate forum has declined to give information under Section of 6(1) of the Right To Information Act.
¶3At the very outset, learned counsel for the contesting-respondent no. 2 raised two-fold objections regarding maintainability of the writ petition. Firstly, the Right To Information Act is a self-contained Act. Secondly, nothing has been brought on record to indicate under what circumstances the petitioner has filed application under the RTI espousing the cause of public at large, as such, the present writ petition is liable to be dismissed.
¶4We have proceeded to examine the record in question and find substance in the objection so raised by learned counsel for the contesting-respondent. Once the Court inclines to dismiss the writ petition with exemplary cost, learned counsel for the petitioner fairly states that the writ petition may be dismissed as not pressed.
¶5Consequently, the writ petition stands dismissed as not pressed. Order Date :- 31.10.2023 A.K.Srivastava High Court of Judicature at Allahabad
