¶1Heard learned counsel for the applicants and the learned A.G.A.
¶2The applicants have invoked the inherent jurisdiction of this Court under Section 498 Cr.P.C. beseeching expeditious disposal of Case Crime No. 14 of 2008 under Section 457, 380 and 411 I.P.C., P.S. Modinagar, District Ghaziabad.
¶3In pursuance of the order dated 13.10.2023 passed by this Court, learned Additional Chief Judicial Magistrate, Court No. 5, Ghaziabad has submitted his report dated 25.10.2023 which appears to be satisfactory. As per report dated 25.10.2023, charge-sheet was submitted on 07.02.2008, however, charges were framed on 18.02.2020. Since then matter is pending for evidence of prosecution.
¶4Learned A.G.A. has no objection, if a direction is issued to the court concerned to decide the matter, expeditiously.
¶5In this conspectus as above, no useful purpose would be served to keep this matter pending. Therefore, this court deems it appropriate to finally dispose of the present application, without making any observation on the merits of the case, as mentioned in the application, with a direction to the learned Additional Chief Judicial Magistrate, Court No. 5, Ghaziabad to decide the aforesaid case strictly in accordance with law by means of a reasoned and speaking order, after affording opportunity of hearing to the parties concerned and without granting any unnecessary adjournments to either of the parties expeditiously, preferably, within a period of one year from the date of production of certified copy of this order. He shall ensure presence of the prosecution by taking all measures as provided under the law.
