¶1Heard learned counsel for the applicant, learned AGA and perused the record.

¶2The accused-applicant seeks bail in GST No. 14 of 2016 arising out of case crime no.165 of 2014 under sections 2/3 of U.P. Gangsters and Antisocial Activities (Prevention) Act, P.S. Karhal, District Mainpuri.

¶3The submission of the counsel for the applicant is that the applicant was enlarged on bail vide order dated 13.11.2014, however, as the applicant had gone out of the State for earning the livelihood, he could not appear in the trial court, which resulted in issuance of non-bailable warrants. The counsel for the applicant states that he is ready and willing to cooperate with the trial. He also undertakes that in similar circumstances, one Imran @ Ismile Khan has been enlarged on bail vide order dated 21.09.2023 passed in Bail No.37473 of 2023..

¶4Considering the statement of the applicant that he will cooperate with the trial and the applicant was on bail, the applicant is entitled to be enlarged on bail. Thus the bail application is allowed.

¶5Let the applicant Vinay be released on bail in aforesaid first information report number subject to his furnishing fresh personal bond and two reliable sureties of Rs.30,000/- (Thirty Thousand) each of the like amount to the satisfaction of the court concerned with the following conditions:

(a) The applicant shall execute a bond to undertake to attend the hearings;

(b) The applicant shall not commit any offence similar to the offence of which he is accused or suspected of the commission; and

(c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
