¶1Heard learned counsel for the petitioner and Shri Sharad Chandra Upadhyay, learned Standing Counsel.

¶2The grievance of the petitioner in the present petition is that he is not being paid the amount spent by him in repairing the roads in pursuance to a contract awarded to the petitioner despite repeated representations being made by the petitioner to respondent no.2 i.e., Superintendent Engineer, Finance, P.W.D, District Mirzapur.

¶3The issue raised in the petition involves disputed question of facts and therefore, it would serve no useful purpose to keep the writ petition pending and call for a counter affidavit from the State-respondent.

¶4The petition is disposed of with a direction that in case the petitioner makes a fresh representation before the Superintendent Engineer, Finance, P.W.D, District Mirzapur, i.e., respondent no.2 bringing all the necessary facts to his notice within 15 days from today, the Superintendent Engineer, Finance, P.W.D, District Mirzapur, i.e., respondent no.2 shall decide the said representation within a period of three months from the date of filing the representation and shall take appropriate action in accordance with law.
