Judgment
Court No. - 40 Case :- WRIT - C No. - 33082 of 2023 Petitioner :- Bijendra Singh Respondent :- State Of U.P. And 7 Others Counsel for Petitioner :- Mukesh Kumar,Rishabh Srivastava Counsel for Respondent :- C.S.C.,Avinash Chandra Srivastava Hon'ble Mahesh Chandra Tripathi,J. Hon'ble Prashant Kumar,J.
¶1Heard learned counsel for the petitioner and Sri Devansh Rathore, learned Additional Chief Standing Counsel for the State-respondents.
¶2In pith and substance, the grievance of the petitioner is that during widening of Iradatnagar Road Chhattapura via Rahlai Pusainta Road under the Pradhan Mantri Gram Sadak Yojana-3, construction of drain is going on only one side of road due to pressure of influential people whereas it was supposed to be constructed on both sides of the road. Petitioner moved representation dated 19.8.2023 in this regard, which is still pending consideration before the concerned authority. He prays that respondents be directed to decide his representation dated
19.8.2023 in the light of report dated 24.7.2023 submitted by respondent no.6.
¶3Learned Additional Chief Standing Counsel has fairly submitted that in case the petitioner's representation is still pending the same will be looked into and processed by the concerned authority within the time period as is fixed by this Court.
¶4Considering the facts and circumstances of the case, we are of the view that no useful purpose would be served by keeping this writ petition pending and dispose of the same by directing the concerned authority to decide the petitioner's representation dated
19.8.2023 in the light of report dated 24.7.2023, as expeditiously as possible, preferably within two weeks from the date of production of a certified copy of this order. Needless to say that we had not adverted any opinion on the merits of the case. Order Date :- 31.10.2023 Manish Himwan High Court of Judicature at Allahabad
