¶1The prayer made in the instant petition is for a direction to the respondents to pay compensation to the petitioner for having taken over possession of his land comprising of Gata No. 779M, Village-Akram Nagar Gari Pargana, Tehsil-Budaun, District-Badaun, without any formal acquisition and payment of compensation. The petitioner places reliance on joint report of the Revenue Team dated 24/29.08.2022.

¶2Sri Rajiv Gupta, learned Additional Chief Standing Counsel appearing for the State-respondents submits that the claim of the petitioner has to be examined by the Committee in terms of Government Order dated 12.05.2016.

¶3Accordingly, without expressing any opinion on merits, the petition is disposed of with liberty to the petitioner to make representation before respondent no. 3 within two weeks from today alongwith true attested copy of the instant order. Respondent no. 3 will transmit the representation to the Chairperson of the District Level Committee for being decided in accordance with law after due notice and opportunity of hearing to the petitioner and also after carrying out survey of the land in question within twelve weeks thence.
