¶1Heard learned counsel for the applicant, learned AGA and perused the record.

¶2The accused-applicant seeks bail in Case Crime No.59 of 2019 under sections 406, 409, 420, 467, 468, 471, 120-B IPC, P.S. Farah, District Mathura.

¶3The FIR in question has been lodged alleging that the company in the name and style of Kalpataru Build Tech Corporation Pvt. Limited had siphoned off various investors with the promise of substantial returns. The applicant was not named in the FIR as Director of any of the group companies. Subsequently, in the investigation, it transpires that the applicant was the director of one of the group companies namely Kalptaru Mega Mart Pvt. Limited for the period 11.06.2008 to 21.09.2013. Solely based upon the said, the applicant was apprehended and continues to be in custody since 11.01.2023. The contention of the counsel for the applicant is that on the same allegations, the applicant has been enlarged on bail by various orders passed by this court which are as under :

¶4Considering the fact that the applicant was neither a director at the point of time when the averments were made and the fact that the applicant has been enlarged on bail in various similar cases, the applicant who is a lady and is in custody since 11.01.2023 is entitled to be enlarged on bail. Thus, the bail application is allowed.

¶5Let the applicant Smt. Reeta Singh be released on bail in aforesaid first information report number subject to his furnishing a personal bond and two reliable sureties each of the like amount to the satisfaction of the court concerned with the following conditions:

(a) The applicant shall execute a bond to undertake to attend the hearings;

(b) The applicant shall not commit any offence similar to the offence of which he is accused or suspected of the commission; and

(c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
