Judgment
Court No. - 3 Case :- WRIT - C No. - 32933 of 2023 Petitioner :- Shiv Nath Yadav Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Anil Kumar Mishra Counsel for Respondent :- C.S.C.,Chetan Chatterjee Hon'ble Siddhartha Varma,J. Hon'ble Manoj Bajaj,J. Upon a provisional assessment being served upon the petitioner, the petitioner replied to the same on 29.6.2023. It is the contention of the learned counsel for petitioner that despite the fact that the reply had been submitted, no final assessment was being made and in fact the men of the Electricity Department were threatening the petitioner to deposit the entire amount as was shown in the provisional assessment. Sri Chetan Chatterjee, learned counsel for Electricity Department submits that reply of the petitioner shall be considered on its own merit and thereafter, only when orders are passed and final assessment is made would the recovery be done. Till then he states that no recovery shall be done. Learned counsel for Electricity Department also submits that petitioner shall be given a personal hearing. Under such circumstances, no further interference is required. The writ petition is accordingly, disposed of. Order Date :- 31.10.2023 P.S.Parihar High Court of Judicature at Allahabad
