Judgment
Court No. - 67 Case :- CRIMINAL MISC. WRIT PETITION No. - 17000 of 2023 Petitioner :- Shivam Respondent :- State Of U.P. And 7 Others Counsel for Petitioner :- Sanjay Kumar Dwivedi Counsel for Respondent :- G.A. Hon'ble Rahul Chaturvedi,J. Hon'ble Mohd. Azhar Husain Idrisi,J. Heard learned counsel for the petitioner, learned A.G.A. for the State and perused the record. The only innocuous prayer of the learned counsel for the petitioner is that a directed may be issued to the respondent no.3 to ensure the fair and impartial investigation pursuant to the First Information Report dated 10.7.2023 registered as Case Crime No. 374 of 2023, under Sections 147, 452, 323, 325, 506 IPC and Section 3(1)(Da), 3(1)(Dha) of S.C./S.T. Act, Police Station Goverdhan, District Mathura. Since the FIR has been registered on 10.7.202, direction for fair investigation in such a short time of the period is unjustified. However, it goes without saying that it is expected from the I.O. of the case to conduct the fair investigation in the matter and submit the report as expeditiously as possible. With the above observation, the petition stands disposed of. Order Date :- 31.10.2023 M. Tarik High Court of Judicature at Allahabad
