Learned A.C.S.C. raises a preliminary objection regarding maintainability of the writ petition and submits that the award dated 18.7.2002 has already been challenged in Writ Petition No. 45001 of 2007 in which a restoration application is still pending and this writ petition has been filed against the recovery proceedings arising out of the award dated 18.7.2002, which is a consequential proceedings as such second writ petition is not maintainable. Confronted with the said fact, learned counsel for the petitioner prays for withdrawal of the writ petition at this stage with liberty to take recourse the other remedy as available under the law.
