¶1Heard learned counsel for the applicant as well as learned A.G.A. and perused the record.

¶2The FIR in question was lodged alleging the recovery of 5 kg of Ganja from the possession of the applicant. In all, from the two co-accused persons including the applicant, a total of 14 kg Ganja was allegedly recovered, which is less than the commercial quantity.

¶3The contention of the Counsel for the applicant is that the mandate of section 50 of the NDPS Act has not been followed and the applicant has no criminal history.

¶4Learned A.G.A. vehemently opposed the bail prayer.

¶5Considering the fact that the recovery is less than commercial quantity and prima face, there being non-compliance of Section 50 of the NDPS Act and the applicant does not have any criminal antecedents, I am of the view that the applicant is entitled to be released on bail.

¶6Accordingly, the bail application is allowed.
