This petition has been preferred by the petitioner, who is a social worker and also a representative of Village Panchayat Bamnauli, Block Tamkuhiraj, District Kushinagar saying that the appointment of respondent no. 6 as a Peon with the Kisan Sewa Sahkari Samiti Limited, Raj Mathauli, District Kushinagar is illegal because he is a brother-in-law of the President of the said Sewa Sahkari Samiti. It is not the petitioner's case that he stakes his claim to the post in question. It is a well settled principle by now that in service matters, no public interest litigation is maintainable. This writ petition is also not one for issue of a quo-warranto and there is no occasion, therefore, for this Court to examine if a quo-warranto lies in this case, given the position held by respondent no. 6.
