¶1The instant petition has been filed praying for a direction to respondents No. 3 & 4 not to pay compensation for the land bearing Plot No. 8/16 Acre situated at village Chikaniya (Dhuriyapar), Tehsil Gola, District Gorakhpur, without deciding the ownership dispute.

¶2Concededly, notification under Section 3-D of National Highways Act, 1956 was issued on 13 January 2023. Counsel for the petitioner admits that till date no award has been made, therefore, it is open to the petitioner to raise all disputes before the Competent Authority as per scheme of the Act.

¶3No good ground is made out to issue any direction at this stage.
