Decided

Case no.
WRIC 37668/2023

Judgment

Court No. - 40 Case :- WRIT - C No. - 37668 of 2023 Petitioner :- Anita Devi Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Ajay Kumar Singh Yadav,Brij Kumar Yadav Counsel for Respondent :- C.S.C. Hon'ble Mahesh Chandra Tripathi,J. Hon'ble Prashant Kumar,J.

¶1Heard learned counsel for the petitioner and Sri Devansh Rathore, learned Additional Chief Standing Counsel for the State-respondents.

¶2Petitioner is a complainant, who had filed the present writ petition for direction commanding the second respondent to make an enquiry in view of complaint dated 7.3.2023 made by the petitioner by calling the meeting of Gram Sabha Karaundikalan, Block-Rampur, District-Jaunpur.

¶3Learned Standing Counsel raised an objection that the writ petition is not maintainable as the petitioner has no locus in the matter.

¶4We have proceeded to examine the record in question and do not find anything on record, which may substantiate the locus of the petitioner to file the present writ petition, who is the complainant. It is well settled law that on behalf of a complainant, a writ petition is ordinarily not maintainable. (Ref. Amin Khan v. State of U.P., 2008 (2) AWC 2002 and Special Appeal No.382 of 2008, Guru Prasad Yadav v. State of U.P. and others) decided on 13.3.2008.

¶5Considering the facts and circumstances, we are not inclined to entertain the present writ petition. Accordingly, the writ petition is dismissed. Order Date :- 1.11.2023 Manish Himwan High Court of Judicature at Allahabad
