Judgment
Court No. - 36 Case :- WRIT - A No. - 17181 of 2023 Petitioner :- Satish Chandra Verma And Another Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Amit Kumar Satsangi,Akash Deep Srivastava Counsel for Respondent :- C.S.C.,Shashi Prakash Singh Hon'ble Manjive Shukla,J.
¶1Heard learned counsel appearing for the petitioners, learned Standing Counsel appearing for the Respondent No. 1 as well as Mr. Shashi Prakash Singh, learned counsel appearing for the Respondents No. 2 & 3.
¶2Facts of the case, in brief, are that mother of the petitioners while working on the post of Headmistress in Kanya Primary Pathshala, Nagar Area-Alval, District Azamgarh died on
27.03.2009. Petitioners being legal heir of late Kishori Verma have submitted repeated representations for release of death cum retiral dues of her mother but till date the said dues have not been released by the Respondent No. 2.
¶3Learned counsel appearing for the petitioners has argued that mother of the petitioners died way back in the year 2009 and since then petitioners are running from pillar to post and dues admissible to the petitioners have not been released without there being any justifiable reason.
¶4On the other hand, Mr. Shashi Prakash Singh, learned counsel appearing for the Respondents No. 2 & 3 has very fairly submitted that ends of justice would be served, if a direction is issued by this court to Respondent No. 2 to consider and decide petitioners' representation by passing speaking and reasoned order within a fixed time frame.
¶5In view of the aforesaid submissions advanced by the learned counsels appearing for the parties, this writ petition is finally disposed of with liberty to petitioners to file a fresh comprehensive representation within a period of 15 days from today, and if such representation is filed, direction is issued to Respondent No. 2 to consider and decide the said representation by passing speaking and reasoned order within a period of two months thereafter.
