At the very outset Sri Vikrant Neeraj, learned counsel for the applicant seeks to withdraw the present application under Section 482 of the Code of Criminal Procedure, 1973 wherein challenge has been raised to the order dated 13.10.2023 rejecting the application of the applicant under Section 311 of the Code of Criminal Procedure, 1973 by the Additional Sessions Judge/Additional Special Judge POCSO Act, Court No.2, Mathura as the same is not properly constituted with liberty to file fresh application with better particulars. To such a submission Sri Chandrabadan, learned AGA has no objection. The application stands rejected with a liberty to file fresh.
