Court No. - 93 Case :- APPLICATION U/S 482 No. - 37072 of 2023 Applicant :- Dhruv Kumar Pal @ Ranjan Singh Opposite Party :- State of U.P. and Another Counsel for Applicant :- Hitesh Pachori Counsel for Opposite Party :- G.A. Hon'ble Arun Kumar Singh Deshwal,J. Heard Sri Sayed Abid Ali Naqvi, advocate holding brief of Sri Hitesh Pachori, learned counsel for the applicant and Sri Padmakar Rai, learned A.G.A. for the State. The present application has been filed for directing the court below to conclude proceeding of Criminal Misc. Case No. 374 of 2018 (Smt. Yogeeta @ Neetu Pal and another vs. Dhruv Kumar Pal @ Ranjan Singh), u/s 125 Cr.P.C., P.S. Badalpur, Gautam Buddh Nagar, pending before Principal Judge, Family Court, Gautam Buddh Nagar, within a stipulated period. Contention of learned counsel for the applicant is that the applicant is opposite party in Criminal Misc. Case No. 374 of 2018, u/s 125 Cr.P.C. Though the order for interim maintenance was passed by the Principal Judge, Family Court, Gautam Buddh Nagar on
17.9.2019 and the applicant has been continuously paying the maintenance in pursuance of that order, but the proceeding of aforesaid case has not yet been completed despite expiry of more than five years. From perusal of the order sheet, it appears that proceeding under Section 125 Cr.P.C. could not be completed because of the adjournment on the part of opposite party No.2. In view of the above, Principal Judge, Family Court, Gautam Buddh Nagar is directed to conclude the proceeding of Criminal Misc. Case No. 374 of 2018, u/s 125 Cr.P.C., P.S. Badalpur, Gautam Buddh Nagar, expeditiously preferably within a period of six months from the date of receipt of copy of this order. With the aforesaid direction, the application is disposed of.
