Judgment
Court No. - 33 Case :- WRIT - A No. - 18311 of 2023 Petitioner :- Amar Singh Verma Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Rahul Saxena Counsel for Respondent :- C.S.C.,Abhishek Srivastava Hon'ble J.J. Munir,J. Heard Mr. Rahul Saxena, learned Counsel for the petitioner, Mr. Abhishek Srivastava, learned Counsel appearing on behalf of respondent no. 2 and Mr. Dinesh Kumar Singh, learned Additional Chief Standing Counsel appearing on behalf of respondent no. 1. The petitioner, who is a Technician Grade-II in the employ of the Paschimanchal Vidyut Vitran Nigam Limited and posted in the establishment of the Executive Engineer, Vidyut Vitran Khand, Amroha-1st, seeks transfer to district Pilibhit in accordance with the transfer policy dated 03.06.2019 and 07.06.2023. The ground is that the petitioner's wife is an Assistant Teacher at Pilibhit, and, in the transfer policy, there is a provision for the husband and wife to be posted at the same place. In this case, if the transfer were to be permitted, the petitioner would have to move from Paschimanchal Vidyut Vitran Nigam Limited to the service of the Madhyanchal Vidyut Vitran Nigam Limited. It would involve a change of employers. Therefore, it is a matter where not even a direction to consider the petitioner's case can be issued. This Court had occasion to consider the issue in Writ-A No. 12060 of 2023, Surendra Kumar Jaiswal vs. State of U.P. and others, decided on 10.08.2023. The principle there is squarely attracted to the facts of the present case. The writ petition is, accordingly, dismissed. Order Date :- 1.11.2023 Deepak High Court of Judicature at Allahabad
