On 11.10.2023, time was granted to file supplementary affidavit. Today, when the case was taken up, supplementary affidavit has been filed wherein in para 4, it has been stated that substitution application is pending in Writ Petition No.47723 of 2012. The writ Court on 20.09.2012 had passed the interim order in the said writ petition directing the parties to maintain status quo, as on date, with respect to nature and possession over the land in dispute. From para 23 of the contempt application, it reveals that some strangers are trying to take illegal possession over the land. There is no mention of such stranger persons either in the application or in the affidavit filed in support thereof. The Prescribed Authority/Additional District Magistrate (Finance and Revenue) has been arrayed as opposite party, whereas no allegation has made against him. From the perusal of the material on record, no case for violation of the interim order dated 20.09.2012 is made out, at this stage.
