¶1Heard learned counsel for the petitioner.

¶2This petition has been filed seeking the following relief: "I-Direct the learned Civil Judge (Junior Division) Second, Ballia to decide the Case No. 03 of 1994 (Saraswati Vs. Umashankar and others), within stipulated period."

¶3The contention is that the aforesaid suit was instituted on

1.1.1994 and the issues were framed on 20.7.2004. It is stated that thereafter, the matter is being listed for cross-examination of the plaintiff-witness.

¶4Under the circumstances and without going into the merits of the case, this petition is disposed of with a direction to the trial court concerned to proceed to consider the aforesaid suit without granting any unnecessary adjournment to either of the parties, provided there is no legal impediment.
