The present petition has been filed challenging the order dated 15.3.2023 passed by respondent no. 2 i.e., Anu Sachiv, Industrial Development, U.P Department, U.P Government, Lucknow and 19.7.2023 passed by respondent no.3 i.e., Commissioner/Managing Director, U.P Co-operative Spinning Mills Sangh Ltd., Kanpur directing for an inquiry into the affairs of U.P Co-operative Spinning Mills Sangh Ltd., Kanpur and the role of the Secretary/Managing Director and other employees in the alleged irregularities in the functioning of Co-operative Spinning Mills Sangh Ltd., Kanpur . The petitioner is a retired Secretary/Managing Director of U.P Co-operative Spinning Mills Sangh Ltd. The inquiry has been ordered on a complaint which refers to the conduct of the petitioner. No adverse order has yet been passed by any authority affecting any right of the petitioner. Merely because the complaint on which the inquiry has been ordered blaming the petitioner for the irregularities cannot be a cause of action to institute the present petition challenging the inquiry proceedings. The petition is pre-mature. It is not a fit case for interference by this Court under Article 226 of the Constitution of India at this stage. The petition is dismissed.
