¶1Heard learned counsel for the applicant, learned A.G.A for the State and perused the record.
¶2It has been argued by learned counsel for the applicant that the applicant is innocent and has been falsely implicated in the present case. Learned counsel further submits that the F.I.R. dated
07.05.2023 was lodged by the complainant against the applicant and seven other persons alleging therein that on 29.04.2023 after 1:00 a.m. in the night he and his wife went to the agricultural field for mowing wheat leaving his two daughters and when they returned back his elder daughter aged about 18 years was not present in the house, he informed by some one that applicant enticed her away anywhere and other accused persons who are also named in the F.I.R. have assisted the applicant. Learned counsel for the applicant further submits that the victim in her statement recorded under Section 161 Cr.P.C. has stated that on
29.04.2023 at about 2:00 a.m. in the night she went with the applicant, the applicant used to come her house from several years, relations were developed between them and they fell in love with each other and physical relations were also developed between them, when she knew that she became pregnant then the applicant asked her for marriage and he took her to Mumbai and thereafter to Nasik. Learned counsel for the applicant further submits that in her statement recorded under Section 164 Cr.P.C. the victim has repeated the same version of her earlier statement recorded under Section 161 Cr.P.C. and has also stated that both have solemnized marriage on 30.04.2023 in a temple and physical relations were made between them on her own will. Learned counsel for the applicant further submits that in the medical examination of the victim no external or internal injury was seen either on the private parts of the victim or on her entire body, her hymen was found old torn and healed and as per radiological report her age was found to be 19 years, thus, she is major. Learned counsel for the applicant further submits that from the statements of the victim recorded under Sections 161 & 164 Cr.P.C. it appears that victim and the applicant were very well known to each other, prior to the alleged incident physical relations were made between them on free will of the victim and victim had gone with the applicant on her own will as she became pregnant, thus, they were consenting parties. Several other submissions in order to demonstrate the falsity of the allegations made against the applicant have also been placed before the Court. The circumstances which, according to the counsel, led to the false implication of the accused have also been mentioned. It has also been assured on behalf of the applicant that he is ready to cooperate with the process of law and shall faithfully make himself available before the court whenever required and is also ready to accept all the conditions which the Court may deem fit to impose upon him. He next submits that applicant is languishing in jail since 25.05.2023, having no criminal history.
¶3Per contra, learned A.G.A. has opposed the prayer for bail of the applicant by contending that the innocence of the applicant cannot be adjudged at pre trial stage, therefore, he does not deserve any indulgence.
¶4After perusing the record in the light of the submissions made at the bar and after taking an overall view of all the facts and circumstances of this case, the nature of evidence and also the absence of any convincing material to indicate the possibility of tampering with the evidence, without expressing any opinion on merits of the case, this Court is of the view, that the applicant may be enlarged on bail.
