¶1The petitioner has prayed for a writ of mandamus directing the respondents to pass rehabilitation and resettlement award in terms of the provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.

¶2Learned counsel for respondent nos. 1 and 2 submits that it has to be examined whether the petitioner is entitled to benefit of Second Schedule to the said Act or not.

¶3Having regard to the same, we permit the petitioner to make representation before respondent no. 4 along with true attested copy of the instant order and in which event, he will decide the claim of the petitioner in accordance with law, after due notice and opportunity to the petitioner as well as respondent nos. 1 and 2 within a period of twelve weeks.
