Judgment
Court No. - 39 Case :- WRIT - C No. - 28222 of 2023 Petitioner :- M/S Gaurav Trading Company And Another Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Satendra Kumar Counsel for Respondent :- C.S.C.,Archit Mandhyan Hon'ble Saumitra Dayal Singh,J. Hon'ble Shiv Shanker Prasad,J.
¶1Heard Sri Satendra Kumar, learned counsel for the petitioners, Sri Laxmi Kant Mishra, learned counsel for respondent nos. 2 and 3 and the learned standing counsel for the State.
¶2Solitary grievance of the petitioners is, the order of the revising authority / Director Mandi Samiti dated 26.04.2016 passed in revision no. 1540 of 2012 (M/S Gaurav Trading Company Vs. Krishi Utpadan Mandi Samiti Etah) has not been complied by Secretary, Krishi Utpadan Mandi Samiti, Etah.
¶3Thus the proceedings remitted to the said authority are described as still pending despite expiry of more than 7 years. In that regard, reliance has been placed on the averment made in paragraph 17 of the writ petition.
¶4On query made, learned counsel for the respondents states that the proceedings have remained pending before respondent no. 3 for reason of non participation / cooperation by the petitioners.
¶5Be that as it may, we find no good ground exists for the proceedings to have remained pending for more than 7 years. At the same time, no useful purpose may be served in keeping this petition pending any further.
¶6Accordingly, the writ petition is disposed of with the direction, subject to the petitioners appearing before the respondent no. 3 on
20.11.2023 at 11:00 A.M., the said respondent may proceed to hear and decide the proceedings on merit as expeditiously as possible in any case, not later than two months from the date of compliance shown by the petitioners.
¶7It is made clear that we have not gone into the merits of the case. Order Date :- 2.11.2023 SK Srivastava (Shiv Shanker Prasad,J.).. . . (S.D. Singh,J.) High Court of Judicature at Allahabad
