¶1The petitioner is claiming 5% developed land in pursuance of the policy of the Noida Authority. Indisputably, the land of the petitioner was acquired for the benefit of Noida Authority and the claim is being made on the basis of the resolutions passed by the Noida Authority in its Board meetings.
¶2Learned counsel for the Noida Authority tried to submit that the petitioner has encroached over the land of Noida and therefore they would not be entitled to the benefit of the policy.
¶3It is admitted to learned counsel appearing on behalf of Noida Authority that no order has been passed in writing declining the claim of the petitioner.
