Manju and others) arising out of Case Crime No. 328 of 2013, under Sections 420, 504, 506 I.P.C., Police Station-Tappal, District-Aligarh, pending in the court of learned Additional Chief Judicial Magistrate-II, Aligarh. Further prayer has been made to stay the impugned orders dated 17.07.2023 and

25.07.2023 passed by learned Additional Chief Judicial Magistrate-II, Aligarh. 2-At the outset, Mr. Vivek Sandilya, learned Senior Advocate assisted by Mr. Saroj Kumar Tiwari, learned counsel for the applicants submits that on account of some defect in the prayer clause, the applicants do not want to press this application. Therefore, they may allowed to withdraw this application with liberty to file fresh application with better particulars. 3-Learned A.G.A. for the State has no objection to such prayer of the applicants. 4-Accordingly, the instant application is dismissed as not pressed with aforesaid liberty. 5-OfÏce is directed to return the certified copy of the documents to the counsel for the applicants within a week after retaining photocopies of the same on record.
