Judgment

Court No. - 64 Case :- CIVIL MISC REVIEW APPLICATION No. - 565 of 2022 Applicant :- State Of U.P. And 7 Others Opposite Party :- Rajeshwar Singh Counsel for Applicant :- Ashish Mohan Srivastava Counsel for Opposite Party :- Siddharth Khare Hon'ble Siddharth,J. Order on Civil Misc. Review Application

¶1Heard Sri Ashish Mohan Srivastava, counsel for the review applicant and Sri Upendra Upadhaya, counsel for the opposite party.

¶2The writ petition was decided by this Court on 07.07.2022.

¶3The review of the judgment is being sought on the ground that subsequently on 30.08.2023 the principle on which the judgment of this court was passed has been reversed by the Division Bench of this Court in the case of Special Appeal No. 29 of 2022 (State of U.P. Thru. Principal Secretary Basic Education Department and two others vs. Uttar Pradesh Senior Basic Shikshak Sangh) along with Bunch of writ petitions.

¶4Learned counsel for the review applicant was passed with a pointed question, whether subsequent change in law gives him right to file a review petition, which he has not been able to answer.

¶5In view of the above, there is no ground for review of the judgment passed by this Court.

¶6Review application is misconceived and is accordingly, rejected. Order Date :- 2.11.2023 Rohit High Court of Judicature at Allahabad
