¶1The instant petition has been filed challenging the order dated 12.07.2016 passed by Chief Executive Officer, Greater Noida as well as the policy of the Greater Noida dated 20.03.2006, wherein distinction was made between Pushtaini Kashtkars and Gair-pushtaini Kashtkars in grant of certain benefits in lieu of the acquired land. It is submitted that the said distinction has been held to be illegal and arbitrary by the Supreme Court in Ramesh Chandra Sharma & others vs. State of U.P. & others; 2023 SCC OnLine SC 162.

¶2Ms. Anjali Upadhya, learned counsel appearing on behalf of the Authority submits that the claim of the petitioner would be considered in accordance with the law laid down by the Supreme Court in Ramesh Chandra Sharma (supra).

¶3Accordingly, we dispose of the instant petition with liberty to the petitioner to make fresh representation alongwith true attested copy of the instant order before respondent no. 4 within two weeks from today and in which event, it will be decided by him by means of a speaking order within next six weeks.
