¶1Heard learned counsel for the parties and perused the record.

¶2The present writ petition has been filed against the order dated 19.08.2023 passed by the respondent no. 2.

¶3Facts of the case are that against an order dated 28.03.2009 passed against the petitioner, a restoration application was filed by the petitioner, which was allowed by order dated 22.07.2023.

¶4Perused the order sheet dated 22.07.2023, there is no indication in the order that the opposite party was heard. After the order dated 22.07.2023, restoration application was filed by the respondent, which is pending consideration and order has been passed on 19.08.203 staying an earlier order passed on 22.07.2023.

¶5The contention of learned counsel for the petitioner is that respondent no.2 be directed to decide the restoration application filed by respondent nos.4 to 6 within a time bound period.

¶6No useful purpose would be served in keeping the matter pending.

¶7Since all the parties are present before the court below let application for restoration filed by the respondent nos.4 to 6 be decided by the respondent no.2 within a period of eight weeks from the date of production of a certified copy of this order as produced before the respondent no.2 after giving opportunity of hearing to the parties concerned and without granting unnecessary adjournments to either of the parties provided that there is no other legal impediment.
