¶1Heard learned counsel for the parties and perused the record.

¶2The present petitioner has been filed for the following reliefs: "Issue a writ, order or direction in the nature of mandamus to direct the Respondents to ensure the peaceful possession of the petitioner over the land situated in Khasra No.1945 area 0.10 hectare granted by residential lease dated

23.8.2003.

ii) Issue a writ, order or direction in the nature of mandamus to direct the Respondents to pass an appropriate order on the application sent by the petitioner through registered post dated 26.08.2023 within a reasonable time granted by this Hon'ble Court strictly in accordance with law.

iii). Issue a writ, order or direction in the nature of mandamus to direct the Respondents to take action in accordance with law against erring persons and ensure the peaceful possession of the petitioner."

¶3Learned Standing Counsel has raised preliminary objection that the petitioner has an alternative remedy under Section 65 of U.P. Revenue Code, 2006.

¶4In view of the same, I am not inclined to interfere in the matter.

¶5The writ petition is disposed of with direction that in case, the petitioner moves an application under Section 65 of the U.P. Revenue Code, 2006, the same may be considered and decided expeditiously, in accordance with law after providing opportunity of hearing to all concerned parties provided there is no other legal impediment.
