Decided

Case no.
BAIL 24439/2023

Judgment

Court No. - 87 Case :- CRIMINAL MISC. BAIL APPLICATION No. - 24439 of 2023 Applicant :- Pradeep Singh Opposite Party :- State of U.P. Counsel for Applicant :- Karunesh Pratap Singh Counsel for Opposite Party :- G.A. Hon'ble Neeraj Tiwari,J.

¶1This is third bail application of the applicant.

¶2Heard learned counsel for the applicant and learned AGA for the State-respondent.

¶3The present bail application has been filed for enlarging the applicant on bail in Case Crime No. 94 of 2021, under Section 3(1) of U.P. Gangsters and Prevention of Anti Social Activities Act, 1986, Police Station-Geeda, District-Gorakhpur.

¶4On being confronted by the Court, learned counsel for the applicant except the pendency of trial, could not establish any new ground for enlarging the applicant on bail.

¶5Learned AGA has vehemently opposed the third bail application and submitted that applicant is habitual offender and indulged in so many criminal activities, therefore, no case is made out for enlarging the applicant on bail.

¶6Considering the facts and circumstances of the case, the gravity of the offence, the nature of accusations, severity of punishment in case of conviction and criminal history of 71 cases, there does not appear any new good ground to release the applicant on bail.

¶7Accordingly, the third bail application is rejected.

¶8Keeping in view that the applicant is in jail since 01.04.2021, the trial court is directed to make all possible efforts to conclude the trial expeditiously, if possible, within a period of six months from the date of production of certified copy of this order.
